Abstract: Subsidence as a consequence of mining activity has been an onerous problem associated with mineral extraction in Britain. Mining law as it relates to subsidence has developed over several centuries. This paper will outline the legal implications for mineral subsidence and compensation, considering both common law and statute. Particular reference is made to the extraction of coal, salt in brine, protection of public utilities, working facilities orders, ironstone and ancient mining rights.
